Location-Based Services Terms
Article 1 (Purpose)
These Terms set forth the rights, obligations, responsibilities, and other necessary matters between Onesoftdigm Co., Ltd. (the "Company") and members when members use the location-based services (the "Services") of the Fitrus health management solution and related services provided by the Company.
Article 2 (Effectiveness and Amendment of the Terms)
- These Terms take effect when a customer who applies for the Services or a subject of personal location information consents to these Terms and registers as a user of the Services in accordance with the procedures prescribed by the Company.
- When a member clicks the consent button for these Terms online, the member is deemed to have read and fully understood all of these Terms and agreed to their application.
- The Company may amend these Terms to the extent that doing so does not violate applicable laws, including the Act on the Protection and Use of Location Information, the Personal Information Protection Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, and the Act on the Regulation of Terms and Conditions.
- Any addition, deletion, or modification to these Terms will be announced through in-app notices, the website, or members' email addresses at least 7 days before the amendment. Changes that materially affect members' rights or obligations will be announced at least 30 days in advance.
- If, when announcing amended Terms under paragraph 4, the Company separately and clearly states that a member will be deemed to have consented unless the member expresses refusal by the effective date, and the member does not expressly refuse, the member is deemed to have consented to the amended Terms. However, the Company will obtain separate consent for changes requiring it under applicable laws.
Article 3 (Application of Applicable Laws)
Matters not specified in these Terms are governed by applicable laws, including the Act on the Protection and Use of Location Information, the Personal Information Protection Act, and the Act on Promotion of Information and Communications Network Utilization and Information Protection, and by the Company's Terms of Service and Privacy Policy.
Article 4 (Description of the Services)
The Company provides the following location-based services.
| Service name | Description |
|---|---|
| Device Bluetooth (BLE) connectivity service | The Company requires location permission to improve the accuracy of device discovery when connecting the app to Fitrus devices, such as the Fitrus Watch, that the Company manufactures or sells or officially approves for connectivity. However, geographic location information accessible through this permission, such as GPS coordinates, is never collected by or transmitted to the Company's servers and is used temporarily only for device connection. |
| Outdoor exercise route measurement service | When a member starts recording outdoor exercise, the Company uses the GPS of the member's device to measure the route, distance, pace (speed), and changes in elevation. This function operates only from the start to the end of exercise recording and continues while the screen is off or the app is in the background to maintain measurement continuity. However, geographic location information accessible through this permission, such as GPS coordinates, is never collected by or transmitted to the Company's servers and is stored and used only within the member's device. |
| Watch weather information service | When a member uses the watch weather function, the Company transmits the latitude, longitude, and city name identified on the member's device to its servers to provide weather information for the current location, retrieves weather information for that location, and provides it to the member's watch. |
Article 5 (Service Fees)
- The Company's Services are provided free of charge in principle.
- Notwithstanding the preceding paragraph, data charges incurred when using wireless services are separate and are subject to the policies of the member's mobile carrier.
Article 6 (Use or Provision of Personal Location Information)
GPS coordinates and routes used to measure outdoor exercise routes are not transmitted to or stored on the Company's servers and are used only within the member's device. Latitude, longitude, and city names used to provide watch weather information are transmitted to the Company's servers, and the Company retrieves weather information for the location through an external weather information provider and provides it to the member's watch. Location information processed on the Company's servers is destroyed without delay after the weather query is completed. Where records confirming the use or provision of location information are generated under the Location Information Act, the Company retains them for 1 year and then destroys them without delay. The Company does not provide personal location information to third parties without the user's consent. When providing personal location information to a third party designated by a member, the Company immediately notifies the member, on each occasion, of the recipient, the date and time of provision, and the purpose of provision through the communication device from which the personal location information was collected.
Article 7 (Rights of Subjects of Personal Location Information)
- Members may withdraw all or part of their consent to the use and provision of personal location information at any time.
- Members may request a temporary suspension of the collection, use, or provision of personal location information at any time.
- Members may request access to or notification of records confirming the use or provision of location information, or correction of errors in those records.
- Members may exercise the rights under this Article through the email address or customer service telephone number specified in Article 11.
Article 8 (Designation of a Location Information Manager)
The Company designates a location information manager to appropriately manage and protect location information and efficiently handle users' complaints.
Article 9 (Disclaimer)
- The Company is not liable for damages suffered by members when it is unable to provide the Services for any of the following reasons:
- A natural disaster or a comparable event of force majeure
- Intentional interference with the Services by a third party
- Disruption of the Services attributable to the member
- Other reasons involving neither intent nor negligence on the part of the Company
- The Company does not warrant the reliability or accuracy of the Services or of information, materials, or facts posted on the Services and is not liable for damages suffered by members as a result.
- The Company is not liable for the loss of profits a member expects from using the Services or for damages caused by materials obtained through the Services.
Article 10 (Dispute Resolution)
